Owner Referral Program Terms & Conditions

This BRECKENRIDGE GRAND VACATIONS OWNER REFERRAL PROGRAM (“Program”) is sponsored by Peak Resorts Management LLC, whose address is 100 S. Main Street, Breckenridge, Colorado 80424 (“Program Sponsor”). In these Terms and Conditions, the Program Sponsor and the affiliates of the Program Sponsor are referred to as “BGV Entitles”, and the timeshare programs that are managed, owned, or operated by a BGV Entity are referred to as “BGV Timeshare Programs”.

Overview of the Program. Under the Program, you may refer to the Program Sponsor individuals who you think may be interested in learning more about vacation ownership in a BGV Timeshare Program (these individuals are each an “Owner Referral”), To make an Owner Referral, you must provide to the Program Sponsor the individual’s name, telephone number, and email and home address. Subject to certain restrictions described below, you may be eligible to receive various benefits (“Referral Rewards”) if your Owner Referral either participates in a sales presentation for a BGV Timeshare Program (“Sales Presentation”) or purchases a timeshare interest in a BGV Timeshare Program (“Timeshare lnterest”),3

Program Participation Criteria. You may participate in the Program if you meet the following requirements:

  1. You have purchased your own Timeshare Interest directly from a BGV Entity and are an owner in “good standing” (i.e., you are current on all payments under your timeshare purchase contract, as well as all assessments, maintenance fees, and dues).
  2. You live in the United States (but do not live in Georgia, Idaho, Maryland, Minnesota, Nebraska, North Carolina, Oregon, Virginia, Washington, Washington DC, or Wisconsin).
  3. The Program Sponsor has notified you in writing that you are eligible to participate in the Program.

Owner Referral Requirements. In order to be considered an Owner Referral, the individuals whom you refer must:

  1. Be personally known to you.

 

  1. Live in the United States in a state where the BGV Timeshare Programs may be sold and marketed.

 

  1. Have not attended a Sales Presentation in the past twelve (12) months.

 

  1. Not currently be an owner in a BGV Timeshare Program.

 

  1. Agree in writing to receive sales and marketing communications from a BGV Entity.

 

  1. Either make a reservation or participate in a Sales Presentation.

 

Program Restrictions. You are not eligible for any Referral Rewards if your Owner Referral does not agree to be contacted by a BGV Entity for sales and marketing purposes or decides not to participate in (or fails to show up for) a Sales Presentation. You may only provide a single Owner Referral once every six (6) months. You are not entitled to additional Referral Rewards for purchases by the Owner Referral that occur after the Owner Referral’s initial purchase of a Timeshare Interest. If an Owner Referral has already attended a Sales Presentation in the past twelve (12) months or already purchased a Timeshare Interest prior to your referral, then you will not receive a Referral Reward for that Owner Referral. If the Owner Referral lives in a state where the BGV Timeshare Programs are not registered for sales or marketing, then the BGV Entities may be prohibited from contacting the Owner Referral and therefore no Referral Reward may be available. Participation in the Program is not available to employees of any BGV Entity.

Additional Terms and Conditions. Your participation in the Program is voluntary and is subject to the Program Sponsor’s selection of you for participation in the Program. All personal information collected as part of the Program will be processed in accordance with the Program Sponsor’s Privacy Policy and will be shared with Program Sponsor affiliates.  The Program Sponsor has sole discretion in determining eligibility criteria and requirements for participation in the Program. In no event may you provide or attempt to provide twenty (20) or more Owner Referrals within any twelve (12) month-period. You cannot conduct or participate in independent advertising or promotions to obtain Owner Referrals, and you cannot participate in any negotiations or otherwise assist in the purchase by an Owner.

Referral of a Timeshare Interest. For the purposes of this Program, married or cohabiting couples are considered to be one single Owner Referral. If you and another owner provide to the Program Sponsor the same Owner Referral, then the first to provide the Owner Referral  will receive the Referral Rewards. By submitting an Owner Referral to the Program Sponsor, you give permission for the BGV Entities to use your name when contacting your Owner Referral. The Program cannot be combined with any other promotional program or offer from a BGV Entity, and is void where prohibited by law. The Program (including the Referral Rewards) and these Terms and Conditions are subject to change from time to time and without notice in the Program Sponsor’s sole and subjective discretion. The Program is governed by the laws of Colorado.

Referral Rewards.

Tour Booking: If your Owner Referral books a project tour and Sales Presentation, you will receive $25 Reward Dollars, and you and the Owner Referral will each receive one (1) entry in a contest to win one (1) grand prize consisting of either one (1) vacation week through Interval International or (1) vacation week at a BGV Entity resort, each subject to Interval International or BGV Entity reservation and use requirements, and the Owner Referral Sweepstakes Official Rules which are incorporated here by reference.

Sales Presentation: If your Owner Referral participates in a Sales Presentation, you will receive Referral Rewards.

Purchase: If your Owner Referral purchases a Timeshare Interest, you will receive Referral Rewards.
